This privacy policy (the “Privacy Policy”) explains the processing of your personal data (the ”Data”) obtained through your access to and use of the My Classic Car Life application (the “App”) and the website www.my-classic-car-life.ch (the “Website”). The App and the Website are operated by a Swiss company MCCLife Sàrl (“MCCLife”), with company ID no.: IDE: CHE-299.996.770.

The use of the App and/or the Website is governed by the provisions of the Terms of Use.

The questions of security and confidentiality of your Data are important to MCCLife. This Privacy Policy demonstrates MCCLife commitment to ensuring the privacy and security of your Data. This Privacy Policy explains also what Data MCCLife collects and why. It is further described how the Data is proceeded. This Privacy Policy explains how your Data is shared, how you can verify, correct and remove your Data if you wish to do so.

By accessing and using the App and/or the Website you confirm that you understand and accept to be bound by the current version of the Privacy Policy.

If you do not agree to this Privacy Policy, you should not continue accessing the Website and you must uninstall the App and discontinue its use.

MCCLife is responsible for the collection and processing of your Data in Switzerland.

  1. How and which Data is collected and why

 MCCLife collects and proceeds the Data you provide through any means including but not limited to the App and/or the Website. The same refers to the Data when you communicate with MCCLife using any of the available contact channel. It is possible to receive from us the Newsletter upon your request by sending us your email address on the Website under a section « Keep me informed ». You can always deactivate this option.

The Data collected and proceeded by MCCLife include the following: full name, home address and invoice address (if different), phone number, email address, language preference, internet protocol address, the Data regarding your classic car life history you store in the App.

The fact that MCCLife concludes with you the purchase agreement of its services available via the App and/or the Website constitutes the legal basis for processing your Data. In other words, the processing of the Data by MCCL is necessary to comply with MCCLife contractual obligations to provide you with the offered services. Furthermore, it is necessary to create or reconfigure the user account. MCCLife has a legitimate interest in processing your Data as this is necessary to assist you when you have questions or complaints about the App and/or the Website. MCCLife will process your Data to send Newsletter, which is a marketing material, based on a legitime interest being able to inform its customers of MCCLife services. MCCLife will also process the Data for internal statistical purposes in order to improve the quality of the services.

 

  1. Cookies

MCCLife uses “cookie” technology however this is not required for the most of its services. Where services are delivered on the Internet, this sometimes involves placing cookies on your computer or other mobile devices. A cookie is a small data file created by a web server and transferred to and stored on your computer’s or other mobile device’s memory. Cookies cannot be used to identify you personally.

MCCLife uses cookies to make its services user-friendly and effective. Thanks to the cookies MCCLife can better understand how the users interact with the services. Cookies enable to recognize your computer or other mobile device, so you don’t have to give the same information every time (e.g. your contact details, username, password).

The Website uses Google Analytics which is a web analytics service. Web analytics is the collection, gathering, and analysis of data about behavior of visitors to websites and apps. Google Analytics helps MCCLife to know how long a visitor stays on the Website or what pages are found most useful. This web analytics service is used by MCCLife only for the optimization of the Website and to make your online experience better.

MCCLife will not use cookies and Google Analytics once you use the App.

  1. How long MCCLife retains your Data

MCCLife retains your Data for as long as it is necessary or appropriate in order to comply with valid legislation or as long as it is necessary for the purposes for which it was collected. MCCLife will store your Data for as long as you are the user of the App. You can delete your account at any time. If you do so, MCCLife will confirm the deletion of your Data.

 

  1. How MCCLife ensures the security of your Data

It is extremely important to MCCLife to protect your Data from unauthorized destruction, accidental loss, technical errors, theft, unlawful use, unauthorized amendment, copying, access or other unauthorized processing.

MCCLife maintains appropriate technical and organizational measures to protect your Data. The Data will not be hosted in any Cloud storage. The Data will be stored and hosted in a single location, the professionally managed and secured data center operated by our partner company, High DC SA (“High DC”) located in La Chaux-de-Fonds in Switzerland. The security protocol used by High DC and certified with ISO 27001 enables, among other things, to guarantee a safe stockage of the medical personal data. This type of data requires a high degree of protection.

However, please be aware that the Data transferred via an open and public network such as the Internet or email, may be accessible to anybody. MCCLife does not warrant and shall not be liable for the security and confidentiality of the Data transmitted by these means.

 

  1. Sharing and disclosure of the Data

You are the owner of your Data. Neither MCCLife nor High DC, will share, transfer or sell your Data to any third person. However, in a limited cases MCCLife may have the obligation to provide your Data to external parties.

MCCLife may be required by law to disclose the Data for example in connection with any legal proceedings. MCCLife reserves the right to disclose the Data only to the extent it is necessary to satisfy any applicable law, to enforce the Terms of Use, including investigation of a potential violation thereof, to detect or to prevent security and technical issues, or to protect the rights of MCCLife or of the users of the App and/or the Website. Please note that in all cases MCCLife will disclose only what is strictly necessary and required by applicable law.

 

  1. Your right to be informed, the right of correction or deletion of your Data

You have the right to request a copy of the Data that MCCLife holds regarding your person.

You may also request rectification or completion of any of your Data. You can also ask MCCLife to delete your Data and not to use it again.

In case you feel that MCCLife proceeds your Data incorrectly, please contact MCCLife using the contact details indicated in point 1 above.

  1. Updates and amendments of the Privacy Policy

This Privacy Policy may be updated and amended from time to time. The most current version will be available on the Website. The updated and amended Privacy Policy shall become effective from the date of publication on the Website. We recommend that you regularly check whether this Privacy Policy has been updated and amended.

 

  1. Applicable law and place of jurisdiction

This Privacy Policy shall be governed by Swiss law. Within the limits permitted by applicable law any dispute arising from or in connection with this Privacy Policy shall be governed by the locally competent court of law for the head office of MCCLife.
